Selangor MB Responds To NGO Criticisms

With the brickbats that's been thrown at the Selangor Menteri Besar, Khalid Ibrahim, on his recent proposal to levy employers of foreign workers to fund a skills training programme for unemployed youths in the state, it is quite heartening to see that he has found it fit to respond in a positive manner. A bit of a change compared to the previous administration whose default reaction was to ridicule critics and then subsequently ignore them.

Among the responses made by the MB was a commitment to utilise legitimate methods to administer this proposal undergirded by a firm undergirding of the respect of basic human rights (which ultimately was the main concern of civil society). He also expressed his appreciation towards civil society groups who expressed their concerns over this matter.

On the issue of the continuation of the "Zero Squatter" policy, he indicated a shift in emphasis towards providing the basic right of shelter for all and ensuring that the right to adequate housing is met. Plans are apparently being made towards reviewing the guidelines of the "Zero Squatter" policy in ensuring a more rights based approach. He also proposed that a consultative process involving the stakeholders; ie. NGOs, the corporate sector, be formalised to provide input as well as to provide a more comprehensive perspective to the policy. Not an easy task, considering the various interests that needs to be balanced.

Dr. Mohamed Rafick Khan Abdul Rahman, a former RMAF officer and well known blogging community leader, has some ideas about the "Zero Squatter" policy that the Selangor state government might wanna have a look at. One of the more obvious one was to change the name of the policy; for PR's sake; if not anything else.

SHAH ALAM, 28 Mac – Dato’ Menteri Besar, Tan Sri Abdul Khalid Ibrahim berkata cadangan kerajaan negeri mengenakan levi RM9 daripada majikan bagi setiap pekerja asing mereka adalah untuk berdepan dengan isu sebenar mengenai pergantungan kepada pekerja asing dan belia yang menggangur.

Beliau berkata wang yang dipungut itu akan diagihkan untuk meningkatkan kemahiran belia supaya nilai mereka bertambah, selain meningkatkan pembangunan Selangor dan Malaysia ke tahap yang lebih mantap.

“Kerajaan negeri Selangor komited untuk mengatasi masalah ini melalui proses yang sah dan menghormati hak asasi manusia dan akan mengkaji dengan lebih mendalam bagi melaksanakan dasar ini,” katanya dalam satu kenyataan yang dikeluarkan hari ini.

Beliau turut menghargai keprihatinan yang dipamerkan beberapa badan bukan kerajaan mengenai perancangan yang dibuat beliau untuk negeri itu sejak beberapa hari lalu.

Tan Sri Abdul Khalid turut memberitahu cadangan beliau untuk terus mengurangkan bilangan setinggan di negeri ini.

“Selangor merupakan negeri yang maju dan rakyatnya perlu mendapat rumah yang mampu dimiliki. Kami tidak akan menangani isu ini sama seperti yang dilakukan kerajaan sebelum ini, yang melaksanakan polisi setinggan sifar untuk memberi tanah kepada pihak-pihak berkaitan dan tanpa menghormati kebajikan setinggan. Sebaliknya kami akan terus menekankan hak perumahan untuk semua,” katanya dalam kenyataan itu.

Garis panduan baru akan diwujudkan bagi memastikan hak dan kebajikan setinggan dipertahankan setiap masa.

Pihaknya juga akan berusaha mengeluarkan setinggan dari kawasan mereka bagi memberikan mereka dan anak-anak masa depan yang lebih baik di samping menjaga kepentingan hak kepada pemilik harta yang didiami penduduk setinggan.

“Kami merancang memperkenalkan proses rundingan dengan semua pihak terbabit, termasuk badan-badan bukan kerajaan dan sektor korporat untuk memastikan semua pihak dapat memberi input dan mendapat maklumat yang sahih mengenai rancangan kami.” – NOOR ALLIA KASSIM

and his actual statement is as follows:
Saya menghargai keprihatinan yang dipamerkan oleh beberapa badan bukan kerajaan mengenai rancangan saya untuk Selangor sejak beberapa hari yang lalu.

Kerajaan Selangor yang baru mendapat dokongan rakyat kerana kami bertekad membuka lembaran baru dalam arus pembangunan Selangor, pendekatan yang akan menumpukan kepada kesejahteraan hidup rakyat, memudahkan perniagaan dan meningkatkan ekonomi untuk semua.

Pertama sekali, cadangan saya untuk mengenakan levi RM9 daripada majikan bagi setiap pekerja asing mereka adalah untuk berdepan dengan isu sebenar berkenaan pergantungan kita kepada pekerja asing dan kepingitan belia kita yang kini menganggur atau tidak mendapat kerja yang sepatutnya.

Wang yang dipungut akan diagihkan untuk meningkatkan kemahiran belia supaya nilai mereka bertambah dan meningkatkan pembangunan Selangor dan Malaysia ke tahap yang lebih mantap.

Kita mesti menerima hakikat iaitu tanpa mengatasi masalah ini kita menjejaskan masa depan negara kita.

Kerajaan Negeri Selangor komited untuk mengatasi masalah ini melalui proses yang sah dan menghormati hak asasi manusia dan akan mengkaji dengan lebih mendalam bagi melaksanakan dasar ini.

Kedua, saya bercadang terus mengurangkan bilangan setinggan di negeri ini untuk membebaskan mereka daripada kitaran kemiskinan dan menjamin hak asasi rakyat untuk mendapat tempat kediaman yang selesa tetapi turut mengiktiraf hak tuan tanah. Selangor merupakan negeri yang maju dan rakyatnya perlu mendapat rumah yang mampu dimiliki.

Kami tidak akan menangani isu ini sama seperti yang dilakukan oleh kerajaan sebelum ini, yang melaksanakan polisi setinggan sifar untuk memberi tanah kepada pihak-pihak berkaitan dan tanpa menghormati kebajikan setinggan. Sebaliknya kami akan terus menekankan hak perumahan untuk semua.

Kami juga akan menentukan perumahan kos rendah mencapai spesifikasi minima yang lebih baik. Garis panduan baru akan diwujudkan untuk menentukan hak dan kebajikan setinggan dipertahankan setiap masa.

Namun demikian, tidak boleh dinafikan kita perlu berusaha mengeluarkan mereka dari kawasan setinggan untuk memberi mereka dan anak-anak mereka masa hadapan yang lebih baik disamping untuk menjaga kepentingan hak kepada pemilik harta (property rights) dalam kawasan yang didiami setinggan tersebut.

Kami merancang memperkenalkan proses rundingan dengan semua pihak terbabit, termasuk badan-badan bukan kerajaan dan sektor korporat untuk memastikan semua pihak dapat memberi input dan mendapat maklumat yang sahih mengenai rancangan kami.

Kami tidak berhasrat meneruskan amalan lama meneruskan kesilapan dan kezaliman dengan penguatkuasaan berat sebelah untuk syarikat-syarikat kroni untuk menyelesaikan isu pekerja asing dan setinggan, tetapi kami mengambil pendekatan baru mengikut proses yang sah yang mengambil pendekatan berimbang terhadap implikasi sosial dan komersial untuk pembangunan Selangor.

Here we have a vision by the new State Government to move towards zero squatters (which I take to mean providing the squatters with decent low cost housing) but before the details and implementation are discussed, these NGOs and groups come out with brickbats.

What is wrong with the vision? I for one think that it would be better for these squatters to move upwards to stay in low cost housing than continue to stay in houses which are built in a haphazard manner (and sometimes hazardous as well).

Rather than jumping the gun and screaming murder at such a policy, the groups which feel "aggrieved" should indicate that this policy would be welcomed provided proper and open consultation is made with all parties BEFORE final implementation. This is give a hint to the MB that they want consultation on the process to be undertaken and prefer a working approach. By criticising a policy without attempting to find out how the new government intends or rationalises such a policy (when all of us know that this new state government might do things differently from the previous government) makes one wonder whether these groups of people actually think before they talk.

But then again, these groups might think also that I don't think before I post this comment :D

Honestly, some times I wonder why don't we wait and see what comes out from the state govt. I believe people should not live in dilapitating squatters and a target of zero squatters in the state is not in itself a bad idea. The problem has always been the implementation approach.

In his entire Malaysiakini interview, what I find most disturbing (for now) is only the pushing the buck to the exco on public declaration of assets.

As for the RM9 levy, I think it is not a bad idea too but after considering some views from NGOs, perhaps the state govt should discuss with the NGOs on how to handle the issue better. But personally, I don't think minimum wages will help much.

i believe we should not tie the hands of the employers too much when they need a proper work force to execute the work but enough hindrance to make them consider employing locals first.

Anyway, let's give them some time to sort things out before bashing them further.

I agree too. I don't get the hoo haa, but I believe it's because of the wording "Zero squatters" which brings back bad memories of tractors mowing down houses or little kids watching their houses being demolished after walking back from school.

I agree with Bob - HE NEEDS A PR BAD.

As far as I know, MB has good intentions, but he doesn't seem to know how to communicate his vision gently. :P

About the RM9 levy - I understand what he's trying to do. I remember when I was in Australia, that my boss had to fork out more for me just because I'm a foreigner. They pay some kind of tax. ;) He's probably trying to do the same ... which would make sense if we're an advanced society that doesn't mistreat our foreign workers. Unfortunately, the opposite is true and another approach should be taken.
